General terms and conditions of business

In these General Terms and Conditions (GTC), we, the cabinet GmbH, Kaiserstraße 8 60311 Frankfurt am Main, Tel.: 0049 157 72110914, E-Mail contact@theluxurycabinet.com, regulate the conditions for orders in our online shop.
 
1. Scope
These Terms and Conditions apply to all contracts concluded between us and you in our online shop. Any conflicting, supplementary, or deviating terms and conditions do not apply.
 
2. Conclusion of the contract
You can order the goods displayed in our online shop by adding them to your shopping cart. You can change your selection at any time before completing your order using the available buttons in the shopping cart. Use your browser's back button to return to the previous steps of the order process. By clicking the "Buy" button, you are accepting our offer to conclude a binding contract for the goods you have selected. We will confirm receipt of your order immediately by email.
The contract text is not stored by us after the contract is concluded and is not accessible to the customer. You can archive your order details and the terms and conditions by saving or printing the data summarized in the last step of the ordering process, as well as the terms and conditions.
The following languages ​​are available for concluding the contract: German and English.
 
3rd delivery
Delivery times stated by us are calculated from the date of our order confirmation. If we offer prepayment as a payment method and you select this option, we will deliver the goods after receipt of payment. If we have not specified a delivery time, it is a maximum of 7 days.
We reserve the right to make deliveries in multiple shipments, provided this is reasonable for you. In this case, any shipping costs will only apply to the first partial delivery.
Delivery restrictions apply insofar as we only deliver to customers with a delivery address in one of the following countries or territories: European Union and European Economic Area
Any applicable shipping costs will be displayed during the ordering process.

4. Prices and Payment Processing
All prices are final prices and include VAT. The price and any applicable shipping costs will be displayed on a summary page before you submit your order.
The following payment methods are available for orders in our online shop: PayPal, instant bank transfer, credit card, and bank transfer. We do not charge any additional fees for any payment method.
 
4.1

When a binding purchase commitment is made for an item, the seller may require a deposit.
Unless expressly agreed otherwise, the deposit amounts to 20% of the purchase price.

The deposit serves to reserve the item for the buyer and to protect the seller against cancellation of the purchase.

The purchase commitment is valid for a period of seven (7) calendar days from receipt of the deposit.
If the purchase is not fully completed within this period, the seller is entitled to withdraw from the contract and retain the deposit, provided the buyer is responsible for the withdrawal.

5. Warranty
There is a statutory warranty for defects. We are liable for material defects and defects of title in accordance with statutory provisions, irrespective of any guarantees we may have given.
In the case of used goods, you are only entitled to a warranty for defects that appear within one year of delivery and are asserted within the statutory limitation period of two years. The aforementioned limitations or reductions of the limitation period for claims for defects do not apply to damages resulting from injury to life, body, or health, from guarantees or under the Product Liability Act, nor to liability for other damages based on an intentional or grossly negligent breach of duty. Liability for the breach of obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance you may regularly rely remains unaffected. In the case of a slightly negligent breach of these contractual obligations, we are only liable for the typical, foreseeable damage.
 
6. Additional Information
In the event of transport damage, we kindly request that you notify us immediately so that we can assert any claims against the carrier. Failure to notify us will not affect your rights, particularly regarding warranty claims.

We would like to point out that, in the case of customized work, the customer should carefully check whether the information they have entered is correct, for example to avoid typos.
The goods remain our property until the purchase price has been paid in full.

7. Liability
Claims for damages are excluded. This exclusion does not apply to claims arising from injury to life, body, or health, from guarantees, or under the Product Liability Act, nor to liability for other damages resulting from an intentional or grossly negligent breach of duty. Liability for breaches of obligations essential to the proper performance of the contract and on which you may regularly rely remains unaffected. In cases of slight negligence in the breach of these contractual obligations, we are only liable for foreseeable damages typical for this type of contract.
The aforementioned liability provisions also apply to our legal representatives and vicarious agents.
 
8. Final Provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the country in which you are habitually resident remain unaffected by the above choice of law. If, at the time of ordering, you are a merchant, a legal entity under public law, or a special fund under public law and have your registered office in Germany, the exclusive place of jurisdiction is Geisenheim.
We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
